1. Acceptance of Terms

By creating an account, accessing, or using Crypto Tek AI's website (cryptotekai.com), Telegram bot (@CryptoTekAI_Bot), web application (web.cryptotekai.com), or any related services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to these Terms in their entirety, you must not use the Service. Your continued use of the Service following any amendments to these Terms constitutes your acceptance of those amendments.

2. Nature of the Service

2.1 What Crypto Tek AI IS

Crypto Tek AI is a software-as-a-service (SaaS) platform that provides:

• Technical analysis tools and indicators for cryptocurrency markets
• AI-powered market data analysis and pattern recognition
• Price alerts, watchlist management, and notification services
• Portfolio visualization using read-only exchange API connections
• Educational market observations and technical data presentation

2.2 What Crypto Tek AI is NOT

Crypto Tek AI expressly does NOT:

• Provide investment advice, financial advice, trading recommendations, or buy/sell instructions
• Act as a broker, dealer, exchange, custodian, or financial intermediary
• Execute, place, or facilitate any trades or transactions on any exchange on your behalf
• Hold, store, manage, or have custody of any cryptocurrency, fiat currency, or digital assets
• Accept deposits of cryptocurrency or fiat currency from users
• Process withdrawals or transfers of any funds
• Guarantee any specific trading outcome, profit, or return on investment
• Operate as or represent itself as a registered investment advisor or financial institution

3. No Investment Advice Disclaimer

You expressly acknowledge and agree that:

• All trading and investment decisions are made solely by you, at your own discretion and risk
• Technical analysis is based on historical data and mathematical models, and past performance does not guarantee future results
• Cryptocurrency markets are highly volatile and carry substantial risk of financial loss, including total loss of invested capital
• You should consult with a qualified, licensed financial advisor before making any investment decisions
• Crypto Tek AI bears no responsibility for any trading decisions you make based on information provided through the Service

4. User Responsibilities

As a user of the Service, you agree to:

• Be at least 18 years of age or the legal age of majority in your jurisdiction
• Provide accurate and current information during registration
• Maintain the security and confidentiality of your account credentials
• Use the Service only for lawful purposes and in compliance with all applicable laws and regulations in your jurisdiction
• Accept full responsibility for all activities that occur under your account
• Conduct your own independent research and due diligence before making any financial decisions
• Apply your own personal risk management practices when engaging in cryptocurrency trading
• Not rely solely on the Service for any financial, investment, or trading decisions

5. Exchange API Keys and Third-Party Integrations

If you choose to connect your exchange account via API keys:

• You are solely responsible for creating API keys with appropriate permissions. We strongly recommend READ-ONLY permissions only.
• Crypto Tek AI uses your API keys exclusively for retrieving portfolio data and open position information in read-only mode.
• Crypto Tek AI does NOT use your API keys to place orders, execute trades, modify positions, or initiate withdrawals under any circumstances.
• You acknowledge that connecting to third-party exchanges is at your own risk. We are not responsible for any actions taken by the exchange or any losses resulting from the exchange's operations.
• You may revoke your API keys at any time through the application settings or directly on your exchange.

6. Subscription and Payments

6.1 Subscription Plans

The Service offers various subscription tiers (Free, Pro, Premium, Diamond) with different feature access levels and usage limits. Plan details and pricing are displayed on our website and may be updated from time to time.

6.2 Free Trial

New users may receive a complimentary trial period with access to premium features. Trial terms, duration, and availability are subject to change at our sole discretion.

6.3 Billing and Renewal

Paid subscriptions are billed on a recurring monthly or annual basis. Subscriptions automatically renew at the end of each billing period unless cancelled prior to the renewal date.

6.4 Refund Policy

Subscription fees are generally non-refundable. However, we may consider refund requests on a case-by-case basis for unused subscription periods. To request a refund, contact us within 7 days of payment through the in-app support system.

7. Limitation of Liability

Without limiting the foregoing, Crypto Tek AI shall not be liable for:

• Any financial losses, lost profits, or trading losses arising from decisions made based on information provided by the Service
• Any losses resulting from unauthorized access to your exchange accounts, regardless of how such access occurred
• Inaccuracies, errors, or delays in the technical analysis data or AI-generated content
• Service interruptions, downtime, or technical malfunctions
• Actions or omissions of third-party exchanges, payment processors, or other service providers
• Changes in cryptocurrency market conditions, regulations, or exchange policies
• Any damages arising from circumstances beyond our reasonable control, including but not limited to force majeure events

In no event shall Crypto Tek AI's total aggregate liability exceed the amount you paid to us for the Service during the twelve (12) months immediately preceding the event giving rise to the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Crypto Tek AI, its owners, operators, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from or related to:

• Your use of the Service
• Your trading and investment decisions
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your API key configuration and exchange account management

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of any technical analysis data or AI-generated content
• Warranties that the Service will meet your specific requirements or expectations

10. Intellectual Property

All content, features, functionality, software, design elements, logos, trademarks, and other intellectual property associated with the Service are owned by Crypto Tek AI and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of the Service or its content, nor may you reverse-engineer or attempt to extract the source code of the software.

11. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws
• Attempt to gain unauthorized access to the Service, other user accounts, or our systems
• Use automated systems (bots, scrapers) to access the Service without our written consent
• Redistribute, resell, or commercially exploit the Service or its content
• Interfere with or disrupt the operation of the Service
• Misrepresent Crypto Tek AI's analysis output as personal financial advice to third parties
• Share your account credentials or subscription access with others

12. Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without prior notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in full force and effect.

You may terminate your account at any time by contacting us through the in-app support system or via Telegram. Account termination does not entitle you to a refund for any unused subscription period.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration in accordance with applicable arbitration rules.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Crypto Tek AI regarding your use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
